These terms and conditions apply to all contracts that a consumer or entrepreneur (hereinafter "customer") concludes with the seller (MCG) with regard to the goods and/or services presented by the seller in the online shop. The inclusion of the customer's own conditions is hereby contradicted, unless something else has been agreed in writing.
A consumer within the meaning of these general terms and conditions is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their self-employed professional activity. An entrepreneur within the meaning of these general terms and conditions is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional and/or commercial activity.
Prices
All prices include any statutory VAT.
We expressly reserve the right to make price adjustments.
The prices are always in Swiss francs (CHF).
Orders/Right of Withdrawal
The product descriptions contained in the seller's online shop do not represent binding offers on the part of the seller, but serve to enable the customer to submit a binding offer. The seller may or may not accept the customer's offer.
Customer orders are binding and the customer declares with his order that he is of legal age and has legal capacity.
If the offer is accepted and there are obstacles to delivery, you will be informed as soon as possible via email or telephone.
You have the option of canceling your order at any time within 7 (seven) days of placing the order.
Deliveries within Switzerland
We normally deliver by post.
For shipping and packaging within Switzerland (including Liechtenstein), a flat rate of CHF 5.00 will be charged for shipping and packaging costs.
For shipments to countries neighboring Switzerland (Austria/Germany/Italy/France), a flat rate of CHF 9.00 will be charged for shipping and packaging costs.
For shipping to countries other than the neighboring ones, the shipping costs are adjusted according to the international tariffs.
If the transport company sends the shipped goods back to the seller because delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment.

Normal delivery times cannot always be guaranteed. Depending on the destination and weight, you may incur additional customs costs. Likewise, there is only an obligation to deliver as long as the purchased goods are in sufficient quantities in stock.

Advance payment through the available means of payment.
Warranty/Liability
In the case of the delivered goods, liability is limited to a replacement delivery. Claims for rescission of the contract, reduction of the remuneration and/or damages are excluded if a replacement delivery is possible within a reasonable period of time. Objections due to defects in the goods can be asserted within 8 days. If the inspection of the defective goods shows that the defects are due to culpable behavior on the part of the buyer (e.g. damage due to improper handling, external influences, etc.), the buyer bears the costs of the replacement delivery.
In any case, our general liability for our own fault is limited to direct intent and gross negligence under all titles; Furthermore every liability is excluded.
return
We will take back unopened goods in perfect, unopened, salable condition within 7 (seven) days; in the case of advance payment against credit. In the case of manufacturing defects and incorrect deliveries, we will exchange the item in question for a perfect copy. Please always state customer number, invoice number and reason for the return. In the case of manufacturing defects and incorrect deliveries, the return is made at our own expense, in the case of returns of faultless, unopened and salable products and in the case of all returns (including manufacturing defects and incorrect deliveries) at your own liability/risk.
Applicable Law and Jurisdiction
If the customer acts as a consumer in the above sense, Swiss law applies to all legal relationships between the parties, excluding the UN Convention on the International Sale of Movable Goods, and the exclusive place of jurisdiction for all disputes arising from this contract is the customer's place of residence.
If the customer acts as an entrepreneur in the above sense, Swiss law shall apply to all legal relationships between the parties, excluding the UN Convention on the International Sale of Movable Goods, and the sole place of jurisdiction for all disputes arising from this contract is the seller's place of residence/business, currently Herisau .
